My landlord wants to move into the flat I rent and live with me. Do I have to let them?Beta*

Your landlord, access and privacy
Private renting in England since the Renters' Rights Act 2025, unless the question says otherwise. General information, not legal advice.

No. Renting a whole flat gives you exclusive possession, and the landlord has no right to live there with you. If they want the property back to live in, they must serve a section 8 notice using the "landlord moving in" ground. That means at least four months' notice, and it can't be used in the first 12 months of the tenancy. After that only a court can end your tenancy. Threats to charge you their hotel bills, to evict you, or to sue you for refusing are attempts to pressure you. Keep every message, and contact your council's tenancy relations officer.
