My flat is being advertised for less than the rent I've been asked to pay to stay. Can they do that?Beta*
Rent and rent increases
Private renting in England since the Renters' Rights Act 2025, unless the question says otherwise. General information, not legal advice.
Since 1 May 2026 tenancies in England no longer end and "renew" on new paperwork. They simply roll on. The only way a landlord can raise your rent is the yearly Form 4A notice, and you don't have to sign a new agreement at a higher rent. If your own flat, or one just like it in the same building, is being advertised for less than the landlord wants from you, save the advert. It is strong evidence for a tribunal that the increase is above the market rent.
